Have to agree Nige the Bombers are digging themselves a very deep hole any thought of higher courts is crazy think Hirds position is all but over but I suppose we will have to wait till this is finished maybe 2016  ::)

Almost certainly, they were clutching at straws to bring the case in the first place, can't see why they wouldn't. I originally thought they were just trying to stall and see what happened with finals but given they went the whole 9 yards it's an expensive stalling tactic.

The trouble is I'm now really torn as I feel for the players and don't think they've done anything wrong, but ultimately the buck stops with them. I reckon ASADA should absolutely hammer the dons bu the trouble is the players are the ones who wear it. I'd like ASADA to be able to slam the club themselves without the players getting 2 year bans...

I don't think they'll appeal, the judge said that even if he did find it unlawful Essendon wouldn't be getting what it wanted

Essendon Football Club is understandably disappointed at todays Federal Court decision.

Before deciding the next steps, we will consider the reasons for the final judgement, including whether or not to appeal this decision.

In taking these proceedings, our priority has been to protect and vindicate the legal rights and interests of the players.

The Club maintains its confidence that, on all the evidence available to us, neither harmful nor banned substances were given to the players during the supplements program of 2012.

Out of respect for the competition and the Clubs still competing this season, it is not our intention to provide any further commentary on this matter beyond today

ASADA did say that if the players were willing to cooperate with them the bans could be as little as 6 months but the Bombers and Hird in there wisdom took them to court , now if the players get longer bans I can see most of the players suing Essendon FC with probably Ryder and Jetta already going down that path they are in a power of trouble

that is also my understanding, which is the whole point. They don't know what they did. But they decide to sack "The Weapon", which is a strange move from a club who think they didn't do anything wrong.  ::)
Essendon have behaved appalingly throughout IMO (doesn;t include the players who I feel very sorry for)

Just saw Hird on TV saying how he felt for the players is this guy for real , pity he didn't have that compassion when he had them jabbed repeatedly for his benefit

And once the show cause notices have been issued, the club/players must provide definitive proof that they took nothing. As they can't, ASADA only needs to show that it is likely they have taken banned substances (the fact that they have issued show cause notices would say they can prove this). I expect Essendon will appeal, as it does not seem they have many avenues left to pursue after this to avoid everything coming down on the club.

I feel for the players, but the club, board and Hird have behaved shockingly throughout in my mind.
