No he is just talking about the duty of care of the AFL which given the way this saga has played out would have some validity 'regardless of outcome'. Mind you in my opinion he'd get no where with this.

The argument that because all the players are actually employees of the AFL, and the AFL acts as the governing body in that relationship it was their duty to monitor the program but it's utter bullshower really, the onus has to lie on the Bombers.

Patrick Keane has posted an updated timeline

1. ASADA to file written closing submissions by 5 Feb
2. Players to file written closing submissions by 12 Feb
3. AFL to file written closing submissions by 13 Feb
4. Tribunal resumes 16 Feb to hear oral closing submissions from all parties.
5. Tribunal to be adjourned approx 18 Feb to consider its decision as to whether a breach of AFL Anti-Doping Code occurred in these matters. Should any player or former Essendon employee be found to have breached the AFL Anti-Doping Code, a hearing as to sanction will follow.

JAMES Hird has failed in his Federal Court appeal to have the joint AFL-ASADA investigation into Essendon's 2012 supplements program declared unlawful.

Federal Court Justice Susan Kenny delivered the unanimous judgment on Friday.

Justice Kenny said there was nothing unlawful in using the AFL's powers to assist ASADA in its investigation against Essendon's supplements program.

The decision means the Anti-Doping Tribunal hearing in relation to infraction notices issued to 34 past and present Essendon players and one former employee of the club will proceed according to a timetable released on Thursday.

Cheers Rico, interesting. Hirdy is gunna have some legal bill even with the wife helping him.
Hopefully the whole thing can progress and be wound up according to the timetable given without
further complications and delays, we all want it over asap.
