I'd love if this case just fell apart. but of my .0000009% logic not affected by essendon bias thinks that if it did, after 2 flowerin years of this shower, would be the biggest joke ever. It would be disgraceful. But please do fall apart ASADA case by all means.

I find it odd that ASADA don't have the power to subpoena witnesses and compel them to testify. One would of thought it would of been set up under the Arbitration Act so that it could as it does handicap it a little. Hopefully they have learnt from this debacle and if something like this in the future arises they will have the power to do so and be alot better prepared. The more this case has gone along the more unprofessional and incompetent ASADA has looked and with many around the world following this case they are a bit of an embarrassment to all of us or atleast thats how i feel. ASADA you really need to have a long hard look at yourself because you are severely lacking more and more credibility by the day. The darkest day in Australian sport yeh right more like the darkest day in ASADA's own history.

While I can see your point Grazz, I feel bad for them that people will have this view as it's starting to appear like they're tasked to complete a job but then powerless to actually do it... If they can't compel people to give evidence, how are they expected to keep sport clean? As soon as someone challenges them it seems all that needs to happen is everyone clams up and ASADA can't do anything about it. How would the police work without the power to arrest people?

My reading is that there are transcripts of evidence from Alavi and Charter. It impacts the players legal teams, who now don't get to cross examine. The transcripts will be interesting.

Yeh your right mate, it is more the way they are set up and the actual powers they have and don't have that are the embarassment. I still feel all these loopholes witnesses have should of been closed or sorted long before now. Legislation and the arbitration act should of been sorted by the Government and ASADA long before arriving where we are now. One would of thought of the back of the comment "The darkest day in Australian sport" that ASADA would have all the power it needs to investigate, build a case and then bring it to court with all the witnesses that are relevant to it. So much incompetence in this country at the higher levels of governing bodies and the Government for that matter. So much money and time wasted because people can't are unable or incompetent towards the task they have been given, it's laughable. To act on the supposed "Darkest day in Australian sport" with only a toothless tiger that is ASADA makes me want to slap everyone that was on the stage the day that comment was made. We pay these incompetent barbies way to much money to see them screw up time and time again without any retribution towards them, all those dickheads standing up there saying "it's bad it's very bad the worst day in Australian sport ever but we will get to the bottom of it and we will insure ASADA have all the tools required to investigate and prosecute" should have their pants pulled down and their @rses belted in public and forced to apologise to the greater Australian sporting public. Incompetent barbies the lot of them and all they really have succeeded in doing so far is embarrass the lot of us in the eyes of the world watching on.

A former Essendon legal advisor says ASADA's case against the Bombers could collapse by Christmas.

The anti-doping authority suffered a major setback in its case against 34 past and present Essendon players today when it failed in its bid to have two key witnesses - Shane Charter and Nima Alavi - subpoenaed by the Supreme Court to appear at Monday's tribunal hearing.

Martin Hardie told Nick McCallum that ASADA barely had a leg to stand on entering the hearing.

"I think ASADA have gone too far to withdraw at this point but I can quite possibly see the whole case collapsing," the former Essendon advisor said.

"It may even be possible the whole case collapses before Christmas.

"Then we'll have the situation where we've had two years of huffing and puffing and chest beating about Essendon doing something wrong and when it comes to the crunch ASADA not being able to put up any evidence.

"ASADA have been conducting what is their normal modus operandi for two years, which is to try and bully people into taking a deal rather than going to a tribunal and putting their case."

Mr Hardie demanded a new anti-doping authority in Australia.

Feel the same mate, i always thought the players were the victims in this. Yes i agree a player or athlete should be responsible for what they take but the Essendon case is a unique one in the sense all those that ran the program were telling the players it's all cool it's all legal so why wouldn't they believe them. Hopefully it's brought about an attitude shift in that everyone won't just except what the powers to be say and do their own homework on whatever will be given to them as they should of in this case, maybe now every athlete in this country will and thats a good thing, we never want to end up back here again.

The Australian has reported that in documents before the AFL's anti-doping tribunal, ASADA is accusing Essendon players of taking a second banned substance and sports scientist Stephen Dank of trafficking peptides to club officials at Carlton and the Gold Coast Suns.




Have been waiting for something like this to come out. Other clubs have always been doing similar
